Europe’s highest court, the Court of Justice of the European Union, has found that CBD cannot be regulated as a narcotic. Businesscan reports that the landmark ruling was part of a case brought by KanaVape after its owners received criminal sentences for producing CBD products. On handing down his ruling, the judge effectively defined CBD as a non-narcotic substance, “The Court notes that, according to the current state of scientific knowledge, which it is necessary to take into account, unlike tetrahydrocannabinol (commonly called THC), another hemp cannabinoid, the CBD at issue does not appear to have any psychotropic effect or any harmful effect on human health.”
The ruling furthermore found that limitations and restrictions placed on CBD products should be administered according to scientific evidence. The ruling creates a precedent for the reclassification of CBD in many other countries and is a boost for manufacturers who are currently battling misperceptions and baseless classifications to govern the use of CBD in products and food. KanaVape’s 200,000 Euros victory has been met with jubilation by CBD supporters all over the world and could well open a new chapter for this health supplement to reach those it most needs to reach.
